I am speaking to coverage, not liability. Settlements are not as often when no insurance coverage exist.

Not my own words but this is spot on.

#1. After spin-out, Ward Jr. got out of car before safety crew or officials where at the scene and crash, major blunder and general rule infraction. #2. Ward Jr. headed strait into on-coming sprint cars without any personal regard to his own safety and those around him. #3. The design of winged sprint cars the visual from the driver seat to the right-side is hampered because of the lower wing panel on the top wing, because Stewart followed another car into the crash area his visual of a Ward Jr. was a split second because of the other car and wing interference. #4. Sprint cars because of design they use a stagger tire system (stagger - Larger right rear tire than the other three tires to help make the car turn left), with a larger right rear tire the sprint car driver uses the throttle to help the car turn left, which Stewart did when he realized there was some one in his pass.

The bottom line Ward Jr. used bad judgment by getting out of the car and putting himself in position to be run-over by any of the other participants, including Stewart. After reviewing the video it's clear Stewart had very little time to respond to Ward Jr. and Stewart from my view point responded correctly; Stewart probably didn't know who had hit his right rear to cause the spin and eventual crash into the wall because he could not see his right rear tire in the beginning of the crash. Tony Stewart was running his racing line and drifting up-into the cushion (Cushion- Racing line that sprint cars use for increased traction) when Ward Jr. raced himself to tight to Stewart right rear tire which created the contact between the two cars.

Speaking from my view point Ward Jr. created the collision because of his racing strategy on Stewarts blind side in the rear, and then made a very wrong choice by getting out of his car and placing himself in direct position to be hit by another car. If the final outcome would have been different and Stewart missed Ward Jr., I feel that Ward Jr. should have been spoken to and maybe even a fined for his actions

Bio - maybe Jesse Ventura can show Stewart how to sue the dead kid's family since you seem fairly certain the kid caused this himself and it's now potentially damaging Stewart's marketability.

I could care less about Stewart's marketability or his reputation. The obvious fact is if the kid did not get out of his car and storm down the track like an idiot just to point out Stewart he would be alive and in the next race. Unless Stewart purposely ran the kid over (which is highly unlikely) I feel it would be the kids fault for simply not using his head in that particular situation.

Getting a grip on the ball has been a problem in the 9th for Santiago and Cozart (twice far), even though they did get the DP on the review.

Actually I think he did use his head which is why he in no longer alive.
