At least four Penn State board of trustees members intend to file an appeal Monday afternoon with the NCAA over sanctions levied against the university after the Jerry Sandusky child sex-abuse scandal because they say the NCAA did not give the school due process in meting out its punishment.Trustees and a person with first-hand knowledge of the discussions said the move is a precursor to a federal lawsuit that will ask a judge to invalidate the sanctions, because trustees expect the NCAA to reject the appeal.

Doesn't the PSU president agreeing to the sanctions make any of that a moot point?

At first I was sympathetic to PSU. I didn't think the accusations could be true. Then the report came out and we learned that grown men choose football over protecting children. Now at a time when PSU needs to show they care about more then football the trustees once again show that football is more important to them then the doing the right thing. These men haven't learned anything proving the punishment is needed to change the culture. I hope since they take the decision to court the NCAA just gives them the death penalty they had discussed.

This is a bad idea for the University. They should just be quiet as a mouse and ride out the storm. This will only keep Penn St in the news for an even longer period and make them look way worse imo.

I don't know about that, is there any rules that limit how much power the President has in decisions concerning the school without consulting the board of trustees?

Oh yes..yes,yes,yes. I'd love to see the NCAA on trial. A lot of eyes need to be opened.

Maybe they will be forced to actually conform to their mission statement.

Yes it would be the schools problem, but it would also void the agreement if there was a stipulation in the schools bylaws and the contract of the President that he must consult the trustees before major decisions that affect the school can be made. I don't know if there is such a thing, I was just asking about it.

The level at which corruption runs rampant in the ncaa makes the Gambino Family jealous. Finally someone might be forced to investigate that sacred cow, those scandals being revealed will open a lot of eyes.

I wonder if this is the beginning of the end for the NCAA? I'd like to see their dirty laundry aired out and let them face the same scrutiny and media coverage that many schools have been facing. (Not that I want to defend anything to do with the Penn State mess)

These penalties were discussed and seriously considered by the NCAA school's Presidents. Thus, they feel the current penalties are giving Penn State a break, considering the severity of their actions OR more precisely their dastardly inaction.

Similarly, Tarkanian vs NCAA went all the way to the Supreme Court and the Court ruled the NCAA was a private organization and not under the jurisdiction of the laws of due process and had the right to punish members who joined their organization as they saw fit. As for antitrust allegations, the Supreme Court said that any school not happy with the NCAA could leave and join another organization or start their own organization.

BTW, only FOUR of Penn State's FORTY SEVEN Board of Trustees have said they would appeal and have threatened suit. Did you know that Paterno had it in his contract that he could put FOUR members on the Board of Trustees of his choosing?

There are those in Happy Valley that just do not get it. Their mind set is just beneath that of Sandusky's.

This is about the dumbest thing the trustee's can do. It just supports the findings of the freeh report about "Penn State Culture". Also when you have a federal investigation coming regarding the possibility of covering up child molestation. You don't want to be fighting two battles at once. Penn State could possibly cease to exist as a school if they are found guilty especially if they go down fighting. The PSU president seems to be the only rational person in Happy Valley.

...as opposed to the 10 year + penalty that it got? Go for it Penn State..your case has validity and your cause is just.

As for "Tarkanian" that is a seperate case, was not without significant dissent, is 20 years old, and alot has transpired since that ruling with the NCAA continuing to enhance and expand it's not so benign power. It might be time to review this...and indeed the NCAA is already being challenged on another front....and very deservedly so.

Would it void it? Or would it cause the person who broke the internal PSU rule to be fired? IDK, just asking. I can see it both ways.

gosh a ruddies, we have an organization formed by its individual members in voluntary association. gosh if PSU does not like the rules, if it does not like be punished for it coverup of child rape it can just quit. Boy that would show the NCAA.
