Backstory: A few weeks ago I walk out the door to head to work and I see a pile of busted up mirror below my driver side rear view. I, of course, immediately flip out as I walk to my truck. Luckily the person that hit it left an apology, their first name, and their phone number on the back of a business card. I call her and when I finally hear back from her she wants me to get an estimate so she can give me a check without involving insurance. That's fine and dandy with me. I get a quote on parts and labor, call her back, and she says she'll drop a check off that night. Nothing. A week later I call her back. No answer. Three or four days later I call her again. No answer. I left messages both times for her to call me back but I've heard nothing. Now my question is, can I turn in a claim with my insurance company with just her first name and phone number? I want to call her again tomorrow and let her know that if I don't have a check by the end of the day then I'm going to turn her info in to my insurance but I want to make sure it's a legit threat before I do.

You may not want to do this but if she keeps avoiding you call and make a police report. If you have a note that has a name and number and a signed admission of guilt I'm pretty sure they can charge her with some sort of traffic violation. This will get the claim rolling.

Not a bad idea. I'd rather just go through insurance but if I have to I would go this route.

Fuck it, if the person is being shitty file a police report. That type of shit isn't cool. If you don't have insurance because you can't afford it or something like that and you hit someone and leave a note that you'll take care of it you better fucking do so.

I'd imagine she has insurance, I just guess she has a $500 deductible which wouldn't make sense to use on a $460 repair.

It's really frustrating that she said she would drop off a check and then all of a sudden I can't get a hold of her and she won't call me back. My guess, based on her name and voice, is she's 55ish years old and from what something she said is that she's a nurse. She said something about being on call or something like that.

Welp, a little sleuthing led me to her full name. Found her name/number in a city of Cincinnati building inspection report pdf through a google search. Not sure if the last name helps me more or not, but it seems like it would.

Damage to your vehicle would be covered by her liability coverage. There is no deductible for liability coverage. A deductible is for collision or comprehensive coverage for damage to your own auto.

If you have a her information, give it to your insurance carrier. After they pay the damages to your auto they can collect (subrogate) from her carrier or against her personally if she is uninsured.

Gotcha. But her rates would go up filing a liability claim, right? I guess that is why she would rather pay out of pocket, initially.

So if I give her info to my carrier there is no chance that I'm going to get stuck paying for this, right? I won't have to pay a deductible and/or my rates won't go up? Probably stupid questions but I've never had to use my auto insurance in the 12+ years I've been driving.

You would have to pay your deductable up front and then your insurance company would try to get it back from her or her insurance company. If you go through your policy you have to pay the deductable no matter who's fault it is.

If you a deductible, your carrier will deduct that amount from the amount of damage to your vehicle. When your insurance pursues her in subrogation, you will receive a check back in the amount of your deductible.

As far as your rates go, the claim will be out there. However, your carrier will not code you as at fault. Since this is a very small loss and the only claim in 12 years, you should be ok for now. (Note: If your insurer increases your rates because of this I would look elsewhere).

No, but I assume it would be cheaper. I can buy the part and install it myself for ~$150 but I don't want to pay anything because some dumb bimbo busted my shit.

Justin,

Send her a certified letter (hmmm.... sounds eerily familiar). Tell her you want a response in 5 days or else you will be filing suit in small claims court, where you will ask for not only the damage to your auto, but other damages as well. If the woman responds by saying she has no insurance or money, let her know you'll take it in installments (if she is hot, let her know other arrangements can be made :) )

The lower the quote you give her the more likely she will pay. When she left that note she prob thought it was going to be $100, dumb slut.
