They are in uniform. They are representing their team and the league. They are in their office, so to speak. The owner/coach/commissioner could absolutely stop them from doing this. Some legal guy on espn said he asked the NFL whether they'd do that, and they didn't even want to address the hypothetical. You're right they definitely could, but I don't think they'll ever actually do it.
