They will probably split the tips at the end of the night. If its a bar, the barbacks, bartenders, and waiters/waitresses will all split. Some places have even started giving the cooks part of the tip. That is usually when the grill is open till 1am, but very few people are ordering food.

Maybe there are privacy laws that I'm not aware of, but I'm not sure there's any expectation of privacy of your name when you write a message to your waitress. If your doctor released something, then sure. But your waitress? What's the cause of action? Public disclosure of private facts? Intentional infliction of emotional distress? Tough to make a case on this one.

FFT, but what about the guy she blamed and that it wasnt him, just someone with the same name?

That type of stuff can stick with a person. A guy I know years ago shared the name of someone who was busted for drugs and it was in the paper and many people saw it. For years after that there were still some people who thought it was him

It sucks, but I'm not sure it's actionable. I don't know much about the law in this area, but I just don't see how she could get in trouble for this.
