That was an interesting read. So, basically it doesn't qualify as a second offense because he was not "intoxicated" in his prior underage. I'm not familiar with Indiana law, but Ohio law does not have a law for one being "intoxicated," unless they are in public and causing a disturbance. My understanding from that article is that Floyd was at a private party, therefore unable to be charged with public intoxication, and subsequently, unable to be charged with being "intoxicated." Ohio treats an underage individual the same whether they have had one beer or fifteen beers.
And ftr, I think Floyd being suspended for the entire year would be ridiculous. I always thought the prior way ND handled situations exactly like this was extreme. It will be interesting to see what BK decides to do with Floyd. In that article, it says he hinted at anywhere from 1-4 games. I don't believe there has been any precedent for a coach in suspending a player who has been arrested three times at ND. My guess is a minimum of 2 games.
