If it violates the constitution why shouldn't they overturn it? (even though you deem it an important piece of law)

Please explain to me how it violates the constitution??

Then why wasn't the Patriot Act deemed unconstitutional?? It violates out right much more than this?

Never mind, I thought you were saying if they overturned a law that violates the constitution they were legislating from the bench. I didn't understand that you meant if they overturned THIS law.

Get ready for a shock...I agree the Patriot Act does violate the Constitution. Just because it was passed under GWB doesn't mean I agree with every stinking thing the man ever did. I believe the Patriot Act is a direct blow to our Bill of Rights protections.

The key tenet of ObamaKare....which states that EVERY American MUST purchase a product to provide themselves health care, is unconstitutional. In AMERICA, you CANNOT legislate Americans MUST purchase a product or be levied a fine or have their liberty infringed (this is known as jail time). This is so simple, yet, the socialists agree that it's part of what is necessary to make ObamaKare work.

The Supreme Court finding a piece of legislation unconstitutional is NOT creating law from the bench. It's doing what, according to the Constitution, they are supposed to do (review what Congress has passed to make sure it meets constitutional criteria).

I don't know where you are getting that it's judicial activism.

Perhaps you're reading too many liberal blogs. :)

Deciding if the laws that congress makes are constitutional is the reason the founding fathers established the SCOTUS. It's called checks and balances. In this case the SCOTUS is not legislating law, its upholding the law!

Ya know, I took a personal oath not to engage in political "discussion" with you Gibby, but when it comes to matters of of down is up, wrong is right, and black is white you have your wires crossed.

The judicial branch was set-up to insure that our laws follow Constitutional principles. If they don't then the judicial branch - particularly SCOTUS - should take action.

HOWEVER, when judges make law from the bench rather than interpret law as submitted by the legislative branch, then we should cry foul.

In this case this is clearly the judicial branch reviewing a perfectly PIECE OF CRAP legislation imposed on Americans and telling the law makers they screwed up. That's PRECISELY what the judicial branch is designed to do.

And to answer your question I agree that the Patriot Act was also an unconstitutional PIECE OF CRAP legislation.

I listen to NPR every morning, and get most of my news from CNN, both of which I think qualify as left-leaning according to the OC. I've never yet heard any of them make any suggestion similar to what Gibby is doing here. Heck, this nonsense probably wouldn't even fly on HuffPo--he's really reaching.

You have to realize that certain posters let their emotions fly away from them when they realize that their own thoughts and beliefs are not widely accepted. Then they become angry that the point that they are trying to make is not being very well agreed to and they become frustrated and say/type the first thing that comes to their mind.

We all have done this from the smallest to larger degrees, but certain folks have this developed into a science and genre all of their own. Most of the time, it's entertaining though! :)
