We are supposed to be renting a condo in Columbus and moving in Sunday from Kansas. We have paid our deposit and got approved to move in. We are renting this Condo thru Lifestyle who built the property. Today another company called my mother associated with the condo administration (who she called to ask who provided cable in the area). This company told us that they will evict us if we move in. They said that to rent a condo theres a list because only so many condos can be rented at anyone time and they have 2 avaiable they can rent us and that is not one. They then called my brother who owns a condo in the complex and told him they would evict us but, they have not called us. I called Lifestyle who owns the Condo and they said that this lady is basically full of it. They said Condo law in Ohio says that they own the property until it is sold and they can rent any unit they want and you cant be evicted by someone who doesnt own the property. They said now if someone had bought the condo then yes they could evict us but this condo has never been sold and that the other company is breaking the law by interfering with a contract. He said he will send us a copy of the documents tommorow and also has a lease and another copy for us to sign on Sunday when we move in. What would you do we are moving from Kansas and have already paid our deposit and basically dont have time to find somewhere else.

I'd be on the phone to a CBus lawyer at the start of business tomorrow.

I know some condo docs contain provisions about what % of development can be rented. Also, kicking out a renter is a long process. I say move in and start looking elsewhere immediately. I know Lifestyles is a scam when you buy based on their financing, but renting should be straightforward so based on all this I would be leary to stay and would look elsewhere.

I live in a Condo, but mine is owned by me. I do know Condo Associations do not like have more renters than owner occupants, because it's harder on the resale of a Condo. (First time home buyers, FHA, VA) Although for a few more dollars they can always throw in a waiver...like in my case.

Unless there is a clause in the Condo Associations By Laws that prohibits that percentage from going over a certain percent and it's the owners responsibility to not let it, then I don't see where the Association can do anything.

Another contract that needs to be looked at is the one between the builder and the association.

If a max amount of renters is only in the owners (aka members) by laws, there is a good chance that it will not apply to the developer.

Also, Lifestyle is a good company, the Deasentis (I always spell their name wrong) family is a good family, known them for years. First place I bought was a Lifestyle condo, you will like living in one of their communities

Who is leasing you the condo? Only the owner can evict you, but I'm not clear on the owner.

Also, the advice that it's a long process to evict someone isn't necessarily true, unless you think 45 days or so to be a long time. Definitely not worth moving in, if you will have to move again in a month and a half. Plus, it's not something you want on your rental history.

You'd have to define good. Lifestyle builds with buy-down financing so the day you sign the papers your condo loses value. Most if not all buyers wouldn't call that good. They run a financing scam, along with dozens of other builders in central Ohio. It's legal, but all homes built with rate buy-downs lose value upon purchase. More precisely, the market value of the property is less than the recorded sale price.

Just about every builder in the world uses that as their own financing.

I just find it funny that he slams EVERYONE. Just letting him know that his words don't go unnoticed ;)

And trust me, it doesn't get me anything more than free tickets to the UA prom at the LC

Don't do that. It will only confuse them.

Not sure where it went but I just posted this.....

Ok, so explain what offering a new-build property with 2% buy-down on the rate does to the value.

because it artificially inflates the sale price. It's offered by banks, builders, Joey the loan shark, etc.

Exactly, so how is buying a condo with an inflated sale price good in your eyes? In anyone's eyes?

It's not up to the seller to make that decision, that is up to the buyer.

Ok, so the community has gone to member management (Onsite is Lifestyle's company). Eh, I would say to find somewhere else to live, it's most likely not a fight you want to get caught in the middle of
