I agree there are grounds for a lawsuit against this site, but I highly doubt that would be something that JJHuddle would want to pursue. It'd be expensive, and they wouldn't get a lot in return other than possibly getting this site to shut down or change its name. They'd be more inclined to spend their money fixing their flawed business model rather than gamble with a lawyer for no compensation.

What harm have they caused JJHuddle? They have only provided another option to another site. JJHuddle doesn't have a monopoly on the market.

There are many websites out there that are close in name. I don't think they'd have a strong case, as you stated, and I don't think they'd get any kind of judgment in their favor. But you're right, they could pursue, I just think it would be a waste of their time and money.

Very possibly. I was just curious if there have been any rumblings. Probably more arguments against it than for it. Mainly I could see a temporary injunction as a means to stop the exodus of members and maybe recapture some if and when they decide to go free again.

And who's to say they didn't expect this? The fee discourages trolls and peope who use mb's as chat rooms and often complain about overly restrictive rules. Maybe they are re-focusing it on being family friendly and mostly about HS football again. I think where they failed would be I would have hand picked key contributors to remain free members to keep traffic up. We all probably underestimate the demand from alumni for whom $12 is chump change to follow their school free of the trolls and childish trash talk.

How does it exactly harm Justin? He doesn't condone it nor encourage it. What people do on their own computer is not of Justin's concern unless it is on this site.

I don't see how any copyright infringement has been committed here though, is what I was saying. Besides huddle being in the name of the site, there really isn't too many similarities. No different than many of the other sports forums out there IMO.

My 2 cents on this part of the quote (as I have nothing to argue about with the rest of it).

1. To TTG: I wouldn't look at immaturity as the main factor behind all the JJ-spamming. The three-day warning the site was going back to pay-to-post....even if you'd paid to post before was essentially the breaking point for a lot of people. When the powers that be starting deleting any complaints and started banning people for being critical of the change, the flood gates opened. If you say "two wrongs don't make a right", I won't argue, but when it comes to immaturity, the way the people over there acted exhibited that trait to a huge degree and set the stage for any immaturity exhibited by others.

2. To DWC: From my perspective now that I've stopped caring about the old site and have mod duties here, I'd say that the simple act of someone going crazy there does nothing to hurt Justin and never could. But when people are using this site to talk about bombing that one, encouraging people to do so, bragging about doing so, etc......it could be a different story (considering details like how we aren't auto-deleting any post mentioning other sites, such as theirs). The way I look at it is to do what you have to do to deal with how you feel about them, but don't make it a public forum event. That's jumped the shark more than the phrase "jump the shark" has and really does nothing to help this site.

If I were to start a website today called "Mipod" promoting free music of local bands, I could be sued by Apple and likely lose eventhough it has nothing to do with IPod and no revenue generation.

I'm just saying the FreeHuddle name was ripped from JJ with the obvious intent to make a connection between the communities to attract people wishing to remain part of said community.

To me it's pretty obvious. You could have chosen any other name. You could have attracted users through other means, but many, many here have been brought over by spamming the address and pm'ing individuals there. In fact, the first few times I saw it I didn't know what it was and thought it was a joke, "fight the power" sort of thing like "free the huddle" or whatever. Had they chosen a different unrelated name, I probably don't make the connection or just don't bother with what I assume is someone just trying to sucker people over to their own site. It was a cleverly chosen name, and that's also the reason I think it's a pretty blatant copyright infringement.
