I saw this story and it brought up several thoughts and emotions. The gist of the story is a mother in Cincinnati has filed a lawsuit against her son's school district. Her son is 11 years old and has long hair. She alleges his teacher put his hair in a pony tail and made fun of him in front of students. The child was horrified and has allegedly been traumatized as a result. She had to remove him from this school and he is now going to another local school.

Obviously I do not know the whole story here but if the teacher did what is alleged is it something that someone should sue over? Couldn't the parent have taken this to the school administration and demanded the teacher be reprimanded and leave it at that? What is the child's damage? Even if he was embarrassed is it the end of the world for him? At that age kids get taunted and teased all the time. Isn't this an opportunity for the parents to teach the child that life stinks, wear a helmet?

2 points for me here, that pretty much jive with Danny.

1. That is not an action that is acceptable by a teacher. Severe punishment, possibly termination, should follow.

2. This is not something to sue about. It doesn't fix anything. Tell the kid to suck it up and move on.

Obv the teacher needs terminated, and legal action is usally the best way to assure that.

It's wrong to do what the teacher did, but suing the school is just as wrong. What did the school have to do with it? Sue the teacher if you must.

jcrazy- the reason people sue the school is because of $$$. The school has plenty of it and the teacher is just some Joe Smoe with a mortgage. Teacher would likely file for bankruptcy.

I don't believe suing is the answer unless the school district did nothing about the incident, that may be the only way to resolve the issue. Now with that said, first get the kid a haircut! No really what does it matter if there is no dress code/hair code at the school. Sometimes people in professions working with kids amaze the hell out of me. Why in your right mind would you think it was okay to do something to a child to bring ridicule to them?? What in your right mind causes you to think its okay to do something to the childs hair?? Some people just don't think!!

I know why, I just don't understand how they can possibly be held accountable.

Under common law, an employer can be held responsible for the acts or omissions by their employees in the course of employment. This is known as the respondeat superior doctrine, or Vicarious Liability. The school could argue the teacher was acting outside of the scope of her employment (which she probably was), but that is a large hurdle to overcome. The court would likely deny any motion filed in that regard and I am sure the teacher's union would strongly oppose.

every poster on here would be calling the child a thug, most posters judging by past posts would vote that the student be spanked or beaten by the teacher (because thats how you get to a child, by beating them).

the child deserves alot more than the teachers firing. i don't know if money is what the child deserves, but for some reason i feel that the child is entitled to more.

I know of a situation like this:

Parents are divorced. After a llong hard fought 2 year battle for custody of the 2 children, the mother was finally awarded custody. Last year the one child missed 60 days of school and the other missed 40 days of school. It is this way each year. The father has called and had NUMEROUS appointments at the school (speaking with the Principal, Vice Principal, Secretaries, Teachers, in-school truency officier and even placed a call to the Superintendant of the School District); Children Servcies, the local police department, etc. EVERYONE from each of the different places is pointing the finger at each other saying they cannot do anything that it has to be "initiated" by so and so. During one meeting with the school's principal, the father was even told that....if you can believe this.....that "they lived in the wrong area of town and that the "inner city kids" were eating up all the "resources" for anyone to go after the mother to pursue the truency laws that the State of Ohio has set down". Too make a long story short. YES, first and foremost, the mother is at fault for not making sure these two kids go to school (she constantly calls them in sick). NO ONE is helping the father make sure these kids get to school. The father has even called the cops to have them go to the mother's home and pick the kids up and take them to school The first time this worked, however, now the mother won't answer the door when the cops show up. The school is not following through on pursuing the truency issue. Do you think in THIS INSTANCE, the school system should be held liable and possibly a lawsuit brought. Both kids are behind in their high school credits because they are failing their classes -- DUH.

This is the problem with the Courts. They are flooded with stupid lawsuits.

I was reading through the comments and supposedly the mom of the kid in question went to the school board and complained and the school board chose not to discipline the teacher.

Seems like she took the next logical step.

Oh, and supposedly the mom is hot. I haven't seen pictures...just from what people (who say they know the family) are putting in the comments of the story.

Most of the posts here say the teacher should be fired. They aren't siding withe the teacher at all.

For being embarrassed? I'm not sure exactly what you think the child is entitled to, so I can't exactly disagree with you, but IMO if there is anything wrong with this country it's the fact that everyone feels entitled to SOMETHING.

If the administration did nothing I wonder if there is more to the story (which I'm sure there is by the way). I would think the leadership, like most, are fearful of potential action and would some how assuage the mother. Maybe the kid is lying or perhaps it was something he did voluntarily? If the mom is hot, I would think all the more reason why the leadership woudl somehow take her position seriously.

Accepting this set of facts, sue away.

I agree...there's got to be something else to this story.

However, from the story given...and if that story is true as it happened...then I don't fault the mom for suing. IF...and that's a big if...the story is true, and the school didn't do anything to discipline the teacher, I would do the same thing.

As a parent I would kick the teacher's ass.

The mom will win.
