.Before you do involve the law, which may well cost you more than the resale value of the ring, there are certain considerations to be borne in mind. Some states decree that an engagement ring given on a special day such as a birthday is clearly a gift and should not be returned. It does not signify an engagement contract but a birthday gift. It could even be considered a bit of a skinflint gift in the first place as he was obviously trying to pass the engagement ring off as your birthday gift and thus saving the expense of buying a birthday gift if he was intending to propose anyway.
Other states consider an engagement ring a conditional gift, thus if a woman accepts a proposal of marriage the ring symbolises the promise of marriage. Thus if the marriage does not go ahead the ring should be returned. This is further complicated though by some states attaching the fault based rule, so if one party backs out they should not get to keep the ring. Other states back the idea of the ring as a no fault conditional gift, so if the marriage does not go ahead the ring goes back even if the guilty party was a slime ball.
