He got nailed first for the possession, and they smelled alcohol on his breath and got him for an underage. They wouldn't have stopped him though if it weren't for having the 12 pack. He was fairly intoxicated (this was a gameday), but its not like he passed out in the middle of the street.

That's not what he was asking, he was asking if pleading not guilty would make sense in this situation. That is asking for legal advice, which should be asked of an attorney, not on a message board.

It's not causing a stir, you should just ask an attorney. That is where you will get the best legal advice.

When I got an attorney for my underage, he cost 4x as much as they underage fine.

99% chance you get put into a diversion program and pay a $250 fine. The program is preposterous and borderline hilarious, and it is expensive too. But you will more than likely have the ability to expunge it end it's all said in done.

It's entirely meaningless. Millions of people have underages, and such a huge majority of people drank underage that no one will ever care. Just don't get a DUI.

Not in a million years. It risks creating an atty-client relationship and potential malpractice. It's a serious issue. That's why you rarely see any OC attys weigh in threads like these. Just not worth it.

Lol dude you don't need an attorney... Just go to court pay the court costs which will be 300 max, they will probably assign you to a diversion program and you'll have to go on a weekend and sit in a class for 8 hours on Saturday and Sunday and listen and do a bunch of BS stuff the diversion program is also like another 300. But after that you can get the charge expunged off your record and you'll be on probation till you turn 21.

Thank you. That is all I wanted to know and basically the same thing my buddy told me.

I was arrested at my bachelor party for public inbox and sent to the ER and the punishment was nothing. I wouldn't get too worked up over it.

Diversion program. Thats what i did. Got it 7 months before turning 21. Was off my record before i turned 21.

I got an underage when I was 18 down in Athens. Pleaded guilty and got a $250 fine or something and had to take a class. Got taken off my record like 6 months later.

Yep, same thing for me...

It'd be stupid as fuck to hire an attorney, IMO.

Why fight something you know you did? Deal with the punishment and it'll all work out in the end.
