Last night I was lucky enough to get my first underage and open container. I am schedule to appear in court later this week. Will I need an attorney? What are the consequences that I am looking at? I turn 21 in July...

Sorry OP, can't help. I was never stupid enough to get an open container citation because I'm not a dumbass.

Hope this helps.

Assuming you got arrested in Ohio, you are looking up to six months in jail and $1000 fine. If you are a first time offender, most likely you will go through their diversion program. Really depends where you got busted. Some places it is a slap on the hand and other places want to throw the book. I would get an attorney.

My friend got an underage from undercovers a week before his 21st carrying a 12 pack from his house across the street to mine. Good times. He had to take alcohol diversion classes (that ironically happened after he was 21) and write an essay for OSU student misconduct.

Ohio State's alcohol reduction task force or whatever BS they started on gamedays was ridiculous.

Well just talked to my buddy who got one a couple months ago. He said I'll probably end up owing around $250 in fines and court fee's, go to an alcohol diversion close, and then it will be removed from my record. He said he pleaded not guilty though. Does that make sense in this situation?

These are questions for an attorney. Why would you seek legal advice on an internet forum? You obviously make young, naive decisions; make a good one and consult an attorney.

I got caught with an underage at 18. Didn't need an attorney and I wasnt arrested. I just had to find a way home.

Had to go to court and I pleaded guilty. Judge said it'd come off my record if I took the diversion classes.

About 300 dollars later and a few diversion classes, it was like it never happened. I did catch aids in a cup during the class though.

You or your friend are lying...you can't get an underage for carrying a 12 pack. He had to of been drinking a beer or drunk to get the underage.

Or maybe he's just having an open discussion and not really seeking legal advice?
