I would qualify being video taped having sex and having that tape distributed as a major mistake, and that brought it to her work. In that regard, she might as well have done it right their in front of her students on her desk, because the affect is basically the same.

I mean, is driving drunk a major mistake? What if someone jaywalks into the path of your swerving vehicle? Like it or not, outcomes that are not completely within your control affect the perception of your choices.

Driving drunk is a major mistake IMO. People don't die when you have sex or smoke pot.

Difference is that's a legal and publicly acceptable activity. Lewd and lascivious behavior is not legal, but when a video tape is distributed it becomes public, even if technically not illegal.

That said, if you are drunk at a bar and videotaped acting inappropriately or grossly intoxicated, you may find yourself terminated from any leadership position, much less one responsible for children. Certain professions and positions are held to a higher standard and expectation of conduct and morality. If you aren't going to live-up to that standard, you damn well better make sure it stays private.

Whoever the guy is must have really had it in for her to do this, not only losing her job but what decent paying job is going to hire her now?The sad thing is that her next option may be doing actual porn unless she wants to flip burgers or work at walmart. If you dont completley trust someone or no one else is getting the video except you then why do it?

If I go to a bar and legally get drunk and someone films me doing it and I get fired for that it's my fault? How?

Filming sex is fucking retarded (fucking retarded is also what an OC member does if I recall correctly) but I don't see why it's grounds for being fired.

Because it creates a clearly inappropriate relationship/lack of respect when teaching children is involved when that video tape is seen. No different than some conduct being inappropriate for a representative of a company, be they a CEO or sales rep or HR administrator.

Also, what you do drunk in a bar matters. If you are just inebriated I doubt you will be fired. If you're dancing on tables and lifting up your skirt, you can and probably should be fired. Tapes of drug use and sex are NOT something parents want their children to find when they google their teacher. I'm sorry, the customer is always right and the parents are customers in this case.

I agree with nearly everything you're saying. From the interview that I saw (not sure if it was the superintendent or some other school rep), it seems like the pot was the real deal breaker. That, I can understand, especially if the school has any kind of anti-drug program going on.

Aside from that, an interesting comment was that the person sending the videos made it clear that they'd keep coming until something was done. I wonder if some of it didn't have to do with just wanting the press to end on it once and for all.

so you need a videotape to know teachers are having sex? believe it or not, teachers are having sex everyday and anyone with half a brain, even students, knows teachers(adults) have sex.

She wasn't fired for having sex, she was fired for a video of her having sex and doing drugs being posted on the internet and sent to parents. She made some bad choices and has to live with the consequences, just like any other adult. Why is this even a debate?

she didnt release the videos and the sex was consensual. only thing the school should be able to point to is the drugs, if they were actually drugs.

what if she was having sex and one of her students knocked on her door to sell her candy bars for a fundraiser. when she didnt answer the door, the kid stepped off the porched and looked into a window because he thought he heard someone inside and saw her having sex. should she be fired for the kid seeing her have sex?

If the one video showed her smoking weed, then I agree with the firing. If it was just for the sex stuff then no, she shouldn't be able to be fired unless she put the videos out there herself.

The school stated they were not firing her for the drugs,they said they couldn't prove she was smoking pot and not a hand rolled cigarette. So a teacher gets fired for having consensual sex with an adult in her home, what was she thinking, did she not get the union update on sexual relations that states all teachers will be forbidden to have sex with anyone over the age of 18. This will spell trouble for a bunch of future workers who have filmed their sexual episodes while in college thinking it was cool, only to find out years later that they are being fired because of the great advancement of technology we call the internet.

Good lord people, stop trying to create the fictional argument that she was fired for having sex. She was fired because it was videotaped - with her consent and knowledge - and that tape ended-up being distributed. People get fired or dinged for jobs because of photos and comments on facebook all the time. Use a little common sense - if something should/needs to remain private, make sure it stays that way. Her lack of discretion is what got her fired, not because she had sex.
