i learned in health class that most babies get herp from everyone kissing on them when there so young

The kid getting herpes is beside the point. The used condom still in the room (and likely in plain sight) is the issue, here. The kid would likely get herpes eventually, anyway. But like some said, the parents should get tested, too.
