Eh....not completely true. He could've asked "Am I under arrest or otherwise detained?" If the cop says no (which is all he could say given that situation), legally he would be allowed to leave.

State of Ohio case law says they can detain you on a traffic stop as long as it takes to run you and have a dog walk around and subsequent possible search. At that point they pretty much have to let you go.

Hell, getting a dog here takes an hour on a good day. We've waited 3-4 hours for one before.

True, but an officer cannot detain you simply on waiting for the dog to get there. He would need to provide a reason to detain you.

BUT, A cop cannot just keep you there longer than reasonable just to try to get you to slip up or "sweat it out".

Yep. He could simply have asked to search the car (and no, he doesn't need a reason to ask). You refuse, he calls for the dog, you're there an hour or two for contempt of cop.

But denying the cop to search the car is not reasonable suspicion. So if the cop is just trying to hassle you, he can't detain you once you refuse, in the state of Ohio.

Otherwise any cop could pull over and search any vehicle without reasonable suspicion just by asking to search your car. You say no so the cop calls in the dogs and searches anyway. Thankfully, it doesn't work that way.

Ha ha, yea. It's funny that the cop shows, where I'd say most Americans get there legal "knowledge", never really go over people's rights. The cops on the shows always get their way and no one ever tells them no.

Only if the canine can be on scene before the normal process of a ticket would be over unless the cop has an actual, real, good, reasonable suspicion. "You look like a pothead focker" is not, "you are acting and responding like you are high" is.
