This would only be comparable if the kid had simply slipped and fell off the tower. That would be a tragic accident that nobody saw coming. The tower was blown over by high winds that were a known risk factor. The lifts operating manual said don't do it, there is a sticker on the machine that says don't do it, but yet he still went up.
