I don't know. I would think murder would supersede any illegally carrying charge. The will probably toss that. You would think that this would erase any Stand Your Ground defense he may have.

My take...you have the right to carry a gun. You have the right to carry a phone. If you want to be that ass hole that texts during the movies so be it. But it doesn't justify shooting the man. Even if the guy threw popcorn at him it still doesnt. You don't end a person's life just because he "disrespected" you. That's what gives gun carriers a bad name.

I know in Ohio the private "no guns" provision does not supersede your right to protect yourself, which includes the use of a gun

Young guy out with wife is now embarrassed and annoyed and to demonstrate superiorly over old guy and defenseless old guy proceeds to push what he justified as being a good dad over rules the theater / cell phone respect other right in public place. This old guy just did not pull out a 38, blow this young guy way on the sound of the keypad now did he? There was a leading up to the end event. Young guy under estimated old guy potential.
Young guy get aggressive ( young want to impress wife and justify his behavior is now going to tell old guy what right) aggressiveness increases because old guy is just old... Surprise old guy doesn't coward frustrating young guy more to the point old police guy is being physically threaten ... Boom bad day both wrong but both justified action.

what happen not right but even on the OC the mentality to disrespect older members is a good indicator of what happen at the movies.....
Just because you are old doesn't mean you deserve respect. Your mentality on life is awful

so you can't have a 42 year old depressed Navy punk?

This is simple trying to Blame someone for their action does not compute... We have a dead good dad and a honorable retire police officer as a shooter. Something when to far quickly and the lives of two families will never be the same. That the sad truth.

Cell phones have been the weapon of killing many incident people this could be just another tragic story added to the list.

We need to license cell phones.... Where the Liberal call to ban cell phones

He is old, retired policeman, and a gun carrier so he must be honorable

Exactly. This guy was clearly a mole, ripped straight from Homeland.

Also pretty sure he was trying to detonate a bomb with his cell phone. Thank god for this brave patriot who took action and stopped the next terrorist attack.

I know. Belly stated that the old man was simply telling the victim that he was breaking the rules. Rules are rules. It seems the shooter was breaking the rules as well. According to several articles, it was posted that no weapons are allowed in the theater.

What's honorable about a murderer?

A comment on NPR sums up my feeling about this pretty well:
I too dislike it when people use their phones in a movie theater. And I too have a hot temper that is easily irritated by people acting like jerks.

But the price of "acting a little bit like a jerk and texting during the previews" cannot be "Someone might murder you". Not if we want to cling to a thin veneer of civilization.

A little kid's dad went to the movies, and is never going to come home to her again. Think about that for two seconds. This isn't a soundbyte, this isn't a fun topic for gun people to argue into the ground. A man got murdered in a movie theater by exactly the kind of "good guy with a gun" we're supposed to feel good about. A woman woke up a wife and went to bed a widow. A little girl woke up with a daddy and went to bed without one.

I find it very upsetting that people respond to this story with variants of "Well, it's terrible, but you shouldn't text in movie theaters."

Come on, man. A family just plunged into the worst kind of tragedy. Have a little compassion.

So someone checking in on their daughter at the sitters makes them a punk? Just stop posting.

Seriously Belly, STFU. You're making yourself look like even more of a retard by saying the cop had some sort of justification.

This thread is starting to resemble the one regarding the Steubenville rape case where FWK was saying it was the victim's fault for getting raped. Belly, please stop. Please.

Belly has more or less said talking or playing on your cell phone in a movie theater = being shot.

You're caught up now.

It's illegal carrying stated in the state of FL CC law in the designated locations stated in the articles of the CC law , but obviously to most of us this man utilized an extremely lame excuse for using his weapon.

I looked in my FL CC law book and it states that "A public or private employer is prohibited from discriminating against an employee or expelling a customer or licensee for exercising their rights to keep and bear arms as long as the weapon is never exhibited except for defensive purposes"

I'm reading this as he had every right to be carrying the gun at the theater even though they have a no weapons policy in place, regardless the man's an idiot.
