Stick to basketball. My opinions are only rooted in facts, logic and reason. your analogy is flawed.
the girl never knowingly got in the car, both literally and figuratively. whereas people who decide to ride with drunks (my cousin died like this) consciously make the choice, this girl did not.
in your scenario, someone is passed out and a gang of drunk people loaded that person into the car without their knowledge or consent and drove off and died. but that person has blood on their hands? lol
