The other robber flees, and the owner chases (big no no). Comes back into the store, walks over/around the kid he shot, laying on the floor, then comes back and "finishes him". Clearly not longer a threat.Verdict? Guilty of murder.
I think this is a different scenario, the store owner left the scene and at that time he was no longer in harms way and then returned to the store to shoot the robber. The homeowner never left his home, so he thought he was still in danger.

I don't think he committed a crime, he was protecting his residence and was scared for his life because of the two people who broke in to his home. If these people would have burglarized a home and killed an elderly homeowner most people on here would be making statements about how they would have killed them both if it was their home. He clearly was insane at the time of the police being called, he said he didn't want to bother them on Thanksgiving holiday. He walks on this one unless he has a past criminal record.

Quit crying about these "kids" being "murdered." The guy may have taken it too far, but they deserve little if any sympathy. Because the reality of the situation is this: Had this guy had a better shot, almost nobody here would be crying over their dead bodies because they would have deserved the punishment they got for entering a stranger's home and trying to steal their shit.

Tough luck. I don't pity them in the least. If there is one got damn thing I cannot stand, it is a fucking thief.

I've read this whole thread twice and some of Clint Eastwoods best quotes keep coming to mind. I won't post them but there is a youtube thread on them.

I was going to post something like this. The old guy took it to far in the end and he sounds pretty messed up but its hard for me to have any sympathy for these young adults.

You don't have to have sympathy for it to be murder. There are lots of people that live a shitty life and I care nothing for them. I wouldn't care if they were dead. Doesn't give anyone the right to murder them.

Like I said, you clearly do not know anything about self-defense laws.

Also, believing this is murder is not sympathy towards the kids. They were scum.

Don't confuse the two.

Also, I find it quite funny that in the thread about politicians making it hard to carry, I was ridiculed and made fun of for having a gun for protection. Yet, in this thread, so many are just fine with 2 people getting shot and then executed for breaking into a guy's house.

Bi-polar threads.

then you have an old man.
in a small community, so these thugs knew or knew of their victim.
his house had been looted repeatedly
a repeated threat to both his property and his own well being
the local police had failed to do their job in protecting him
when law enforcement breaks down and you can not feel safe in your own home then kill'em.

And he had every right to shoot until the threat to his life was gone. But then he kept going. Not surprised you don't understand.

The ridicule was for feeling like you had to protect yourself at all. One person even said you should move if you feel like you have to have self-protection.

How so? You don't have enough info to come up with that conclusion. He was broken into before, that is all you know. You don't know the cases or what the police did. Do you expect the police to put armed officers around the perimeter of his property?

No one is disputing his right to take his first actions.
"I think the first shot is justified," Olson said. "After the person is no longer a threat because they're seriously wounded, the application of self-defense is over."

Go back and read what you replied to, that you said you were going to post something like it. Sympathy for a victim has nothing to do with being murder or not.

I have no sympathy for the victims, but it was still murder.

Also, rotinaj, my comment was directed at everyone talking about sympathy, not just you directly.

He is an old man and the law failed him..
” He showed police the window he says Brady and his cousin, Kifer, used to enter his house, which he said had been broken into several times before. “
“
Smith's brother, Bruce Smith, said about $10,000 worth of guns, electronic gear and cash were stolen in October.”
‘Wetzel, the sheriff, declined to discuss what was taken in the October theft and said they have no suspects.”
“
They tortured him and targeted him, and it's not good," Lange said. "If you've been broken into one time, that would be enough. But it's terrible."

Like I said, he walks. There are other circumstances to this case that will lessen the punishment.

#1 rule of self defense, you notify police the immediate second you are out of danger
#1.1 rule of self defense, you never ever touch or move the body
#1.2 rule of self defense, you never "finish them off"

He will be convicted of 2 counts of manslaughter at the minimum.

Smith had no prior convictions, according to a database managed by the Minnesota Bureau of Criminal Apprehension. His brother, Bruce Smith, however, told the Star Tribune that the Little Falls man was on edge because of seven prior break-ins at his home in previous years
