A lawyer will also tell you to shoot to kill, because you dont want it to be their story against yours.

Shooting to kill an intruder is one thing. Executing a kill shot under the chin of an intruder is another. I am not too bothered though. As far as the wood chipper comment? Can anyone say FARGO?

Murder. Easy case. Surprised there is this much discussion about it.

I know. You said he was a typical redneck because of what he said, but since I'm supposed to be the residential redneck, I was just pointing out that even I thought he should be charged with murder. Lol

Ok, you let someone break and enter and possibly kill you then. LOLfail. "Oh hey der criminal guy, breaking into my house I see. Oh you have weapons to complete your robbery and possible murder of me too? Well I don't want to be a redneck so I am not going to bring out my gun in self defense and shoot you. Hey you can murder me, but at least I will never be remembered as a redneck. LOLfail.

The guy had every right to shoot them in self defense. If you don't want to be shot at, try not to do scumbag things such as breaking into people's homes. With that being said, he did take it too far, and the story seems very sadistic beyond the self defense of the B&E.

Agreed. I have no problem with him defending himself, but he went way too far. What he did is murder.

Yup, it seems like it was a dream scenario for him. Def seems like he was getting off from it, otherwise he wouldnt have been a dumb fuck and told the whole story in detail.

Everything you said is correct. However, that does not describe this case. Once the threat is removed, you cannot just "finish them off". Hell, people get charge for shooting too many shots sometimes!

This is a clear case of how not to do self defense. Someone above mentioned someone shooting someone in the back after robbing a store. That person is lucky to not be in jail. That is almost a guaranteed murder case.

I am 100% for self defense, including killing intruders in your home.

However, this guy went WAY too far.

Once he had shot them both once and they weren't dead but definitely unable to move. He should have called the police. Had he done that he would be labeled a hero and not a murderer EVEN IF they died in the hospital.

A 16 yr old breaks into your house, you're sitting there in a chair waiting for them to come up the stairs (aka not afraid for your life) you're going straight for shooting? They were there to steal drugs, not rob, kill, PHIHWB, and upper deck him. Not surprised that went over your head though.

a 7 yr old breaks into my house to steal some video games, I should go straight to shooting then right? Dog takes a piss in my yard, I can shoot the dog and be justified right?

They were 17 and 18. Old enough to do damage to an old man. Lol at thinking they are harmless because they are teenagers. If they have a gun or knife, doesn't matter if they are 40 or in their teens, they are a threat to your life. If i was in the situation I most likely would not be hesistant to shoot. You have no idea if they have a weapon or not, and im not going to risk it. Sorry, I am not going to ask for their resume to see how old they are and why they are in my house.

Yeah I would reach with the dramatic spin too if I wanted cover up my fail.

Not a fail thanks. Its happened to him before, I think he knows the drill. He clearly wasn't fearful of his life. I understand the point of not knowing if they have a weapon or not, but if he's casually waiting for them, and can look and see if they have a weapon. If you have a gun, I'd assume one can tell someone to freeze, hands up etc.... Firing on first sight IMO is a F4F type move.

I was more speaking in general for a B&E scenario, however just because the guy has gone through it before doesn't mean the situation is exactly the same. Not sure how a 64 year old man would be able to tell if his potential thieves had a weapon or not from upstairs.

Well if he's sitting and waiting for them, obv has gun experience, I would think he could hold up the gun, say "Stop right there" or something to the effect and see. If they raise their hands with a gun shoot. Otherwise the situation is covered. Really not that difficult IMO.
