My daughter will sublease you her Studio for $863.00 month ... she has already paid the starting fee ..plus she may be will to play one month free... which will leave you with a 10 month sublease.. Lakeview area she has another place she want plus she will be leasing a 2 bedroom with new roommate.

When you moved in, especially in addition to the email, you've clearly accepted terms of an oral agreement (likely referencing a lease). If the place was filthy, you're only recourse would have been to snap a few pictures and then immediately leave, citing apartment was not delivered in condition acceptable to you.
But after a week, this issue is really between you and the roommate. This lady takes you to small claims she probably wins, quite possibly for the entirety of the term of the sublet.
I'd send her a check for $365 and say it represents payment in full and you will not be subletting the remaining months. If she cashes it, that's acceptance of your settlement offer. If she's smart, she will accept it under protest as partial payment for what is due. But after sending the check, cease any form of communication with her. And make sure your email doesn't send one of those "confirmation receipts".
