Suppose you did decide to wake her up right then and there to give her the boot out, would it be smart to make sure you're not the only one around? Perhaps have a mutual friend there also just in case this chick did decide she wanted to make a claim that you took advantage of her?

So if a chick (drunk or not) begs for it from some guy and in his drunken state he bangs her, then in the morning he regrets it. Maybe it was just because she was ugly and fat and his friends found out. Under this logic he can then file charges and claim he was taken advantage of in his drunken state. Like I said above jurors would be unlikely to convict in these cases. Many times prosecutors do not even take them to trial.

Bottom line don't get drunk, strip down to your thong, and get into a dudes bed.

It depends on the situation and the evidence to support the claim. Like I said in this circumstance I would not vote to convict. Now if a 200lb drunk guy forces himself on a 115lb drunk women and there was clear evidence to support it I would vote to convict. Like scratches and other physical evidence.

I believe there are actually only like 5 states with such laws, otherwise we are talking blacked out/passed out which can be hard to prove - since the body continues to process alcohol it can be hard to prove inability to consent at the actual relevant time. Absent other compelling evidence/witnesses, most DA's probably won't touch such a case where a girl is just really drunk (and not passed out). Of course, you always run the risk that once such a case proceeds to trial, the guy can be up shit's creek in a he said/she said.

My thought is that opping in the sack with a seriously drunk chick you don't know well is asking for trouble even if she appears willing. I've heard of way too many instances in which young women do something they later regret, and decide they must have been raped in order to clear their own sense of guilt. As the Duke lacrosse team can attest, your name will eventually be cleared (legally, at least - probably), but having to defend yourself in a situation like that doesn't sound like something I would want to go through.

The sad part if it is that there are some real rape situations that go unpunished because of a few women like this.
