Yes they can. I work in a restaurant as well. They can send you home for being sick. They can fire you the next day for not coming in for being sick, even if they know you're sick, if you don't have a doctor's excuse. Almost all restaurants do it. And the kicker is: I'm a server...my restaurant, and MOST restaurants, you can only get health insurance through the company if you average a minimum number of hours per week (usually it's 30-32). However, they won't schedule you enough hours to average that, so you aren't eligible for insurance. BUT, you have to go to the doctor if you're sick, or they'll fire you. So you can't get insurance because of your work, but you have to have it or you'll get fired. Sounds great, doesn't it? So that's why every time I'm sick, I show up at work. That way they have to decide whether to let me stay and cough/sneeze/puke or whatever all over their guests, or send me home sick. If you put it on them to send you home everyday you're sick, they can't fire you. But the first day you don't show up w/o a doctor's note, you're screwed.
