I'd consult another lawyer. Most offer free consults nowdays. If the 2nd lawyer says the same thing, take the plea.

Seriously. You can do without booze for a year and it will go quicker than you think.

BTW was talking to a friend the other day and her brother got his 3rd DUI which was dropped down to what they call Physical Control. His other 2 DUI's were dropped down to reckless ops.
So, he ended up paying out about $4,000 including court/lawyer fee's, did 4 days in DIP and had work driving priveleges all along.

Definitely consult another lawyer.

You show me someone who thinks <.08 is drunk and I'll show you someone who is beyond ignorant when it comes to BAC and alcohol consumption. I was ignorant to that fact. I was absolutely fine. ("OHHHH THEY ALL SAY THAT!!!") Yeah, maybe; I don't know. All I know is that "are you good to drive?" used to be the test, and now I'll buy a breathalyzer and let people know even when you're sober you're still pretty close to the limit.

But your assumption that I was a danger to anyone that night is wrong. And I was only speeding as much as the officer was, funny how that works.

i would get another lawyer. with these types of cases, what you really need is a local attorney that deals with this judge a lot.

I'm not trying to sound judgmental, but you wrote, "I'm an honors student, Eagle Scout, religious leader, etc."

1. Honor students should have more brains then to get themselves into a situation like this.

2. What does being an Eagle Scout have to do with this?

3. Religious Leader? Um, seriously, don't use that line in court. A Religious leader at age 20? What, you mean you help the priest sip the wine after communion? That's the problem with religious people, they neglect that "relationship with God" thing which would help develop your character into someone who wouldn't have put themselves in this situation at all.

If, he wanted to have fun and disregard his religious leadership abilities and honor student mind-set, then do it, but then own up to the punishment and realize you made a mistake and let it go.

I like the idea of talking to a 2nd lawyer. If they both say take the deal, then I would take it. I think DUI (even if you would have been legal had you been 21) is a much bigger deal than underage consumption and they might try to make an example out of you.

Just because the cops or the law says something is inconceivably wrong doesn't necessarily make it so.

If the OP's story is true then he was acting pretty responsibly that night apart from letting his friend drive to the BK.

Well hey it was just the lawyer's play. In his experience they treat good people better than repeating offenders. Want to know why they didn't just give me community service like everyone else? I do too much of it. To graduate from HS we had to do a meager 20 hours, in my senior year alone I did over 400. While I don't have free summers and time in college, I still get out there every now and then. In my opinion and my lawyer's opinion they are giving me the parole because they know I don't have monetary issues and community service wouldn't teach me a lesson because I do it anyway. As for the religious leader, I lead a annual retreat called Kairos every fall with my former high school. Luckily, my license will be renewed November 5th, so I can make the November 10-12 dates this year haha

But just to make a point again, I know I was absolutely in the wrong. I was, and am, a drinking novice and figured three beers would be like a .03. No, actually .07. I also understand what typically happens with an underage and am fine with it. Like I said before I'm not looking to get off free. I simply wanted to vent, collect a few "cool story bros" (nice job ccrunner) and see if people agreed I'm getting a raw deal in comparison to their experiences. And obviously, I am.

To echo everyone else I'd get that 2nd opinion. That said, whether you like the laws as stated or not, you broke them. I think its a little harsh and I don't see why the Prosecutor gave you the big bad cop speel because its not up to the cop as to your suggested punishment, its up to the DA and your prior record/character references should have been enough for a simple ticket/court costs/alcohol involved crime 1 year probation. However it is what it is and you're going to have to face the music.

Or you could have mama "donate" to the judge's reelection campaign with some of those millions ;)

I will bet any amount of money that is false. If you think judges don't take into account what type of person someone is or if their a habitual offender, you're an idiot. A family friend of mine is a magistrate in Toledo and the first thing she said was that presenting them a picture of who you are and that it was an egregious accident is the best thing you can do.

I don't mean to sound like a bitch or to think I'm special. These "religious leader" comments are a bit much, but society is a prick so it is what it is.

I stopped reading all the posts so excuse me if someone has made these remarks already, but it doesn't matter if you had one beer, you are still over the limit to drive. Lesson learned here is don't fuck with the law. Come on man, you were lucky to get off the first time. With that in the back of your head, why would you even try to put yourself at risk?
