I am thinking the employee of CVS was not allowed to restrain, chase, etc (my girl is a manager here in Florida for CVS, they are not allowed to here)... anyone but just call the police and file a report. However the employee did give chase and I will be honest I am surprised he wasn't charged criminally but like I said above he is gonna be sued no doubt!

i would have to say the guy deserved it but there should be some type of punishment because his life was taken and he didnt deserve to die for it

What a fucking idiot. Dude probably makes $8 an hour and is willing to murder someone because they stole $4 of shit.

You know what that is a totally fair question and now that you put it that way I have to look at it differently but if you are speeding, just 5 mph over who is to say that when the police tried to pull you over and you decided not to comply a death was the result. I understand this incident wasn't the police so if a citizen tried to stop you in a car well that is just stupid! :)

Pretty clear case of manslaughter I imagine. I'm not lawyer but I don't think you're allowed to kill people in the streets.

I think this is the wrong approach when we're talking about the taking of a life. I do care about the end result when we're talking about killing someone over crayons and toothpaste.

Like I said, if you are going to chase down a shoplifter, that's your perrogative, but you ought not to kill him in the process (especially by squeezing his throat for several minutes when he says he can't breath).

And if he can talk he can breath??? That may be true to some extent but not totally. Something tells me this guy wasn't faking when he said he couldn't breath.

And it was a pretty weak shoplift. Grab some Groundball Grape too if you're gonna lift.

The CVS employee definitely went too far, and should have criminal charges brought against him.

I don't believe you should kill unless there has been physical harm done or implied.

I don't care about the end result because at the end of the day my life isn't affected. Like I said, he doesn't steal it this doesn't happen how wrong it may be isn't the point. He decided to take off with stuff that didn't belong to him and it cost him his life, I never said he deserved it or got what is coming to him. If I knew him or the CVS person perhaps I would care but I don't.

Put it this way, steal something from my house how ever trivial it is and I confront you there will probably end up being a fight if you don't hand over said item. We all know accidents can happen very easily when punches are thrown or choke holds are applied. :)

The CVS manager should be choked to death for being a fucking moron.

Toothpaste and crayons is not a reason to chase someone down and put them in a choke hold for severaly minutes, ultimately ending his life.

Fab, there is a difference when somebody steals from a store and someones house. If somebody unlawfully enters your house, you have every right to defend yourself and take action.. Not the same when somebody shoplifts from a store.

And I don't buy the if you can talk, you can breathe. I actually know that not to be the case. Also, he must have NOT been able to breathe as he is DEAD.

Again I am not saying I agree with anything the CVS person did at all, all I am continuing to say is if there is no theft, there is no death. People need to realize, if you are going to commit a crime no matter how petty it is, someone may try to stop you and that could mean physical harm or in some cases death. I don't for one minute believe this CVS person tried to kill this person. This CVS person tried to be a hero, had no clue how to handle the situation and just made it a million times worse!!

Also if you can talk your airway is open!!! Where did it say he was talking the whole time? I am sure when the hold was applied his first reaction was to say I can't breath I can't breath but I am willing to bet he went silent after that, airway closed then resulting in his death.

The CVS dude is responsible for the dudes death. In no way was his action appropriate for the situation.

Hell, there are cameras all over CVS. Call the cops, give them the tapes and be done with it. $5 worth of stuff isn't worth someones life.

(In no way does this mean the dude stealing wasn't wrong but he certainly did not deserve to be murdered)

Actually Fab is right, if you can talk you can breathe. Anyone who's ever studied any grappling/wrestling/jiujitsu/etc knows that.

Like Fab said, most wrestling referees, that's how they can tell if the kid is faking to get off their backs or not. If they actually say something like "I can't breathe" or "He's choking me" then he's breathing just fine.

All this is why I said earlier, that when the shoplifter said "I can't breathe" the CVS manager probably adjusted the choke hold some and the result is what we read...at that point he couldn't breate.

It's far more likely that the dude died from lack of blood to the brain than from lack of oxygen. Don't choke people if you don't know how that shit works.

Which is why CVS will likely be writing a very large check to this dude's family and then probably terminating this employee. By terminate I mean fire, to no longer employ, not choke to death although there would be some poetic justice in that.

I'm still wondering why not a single witness took action while a man was choked to death for several minutes in front of them.

A simple "What the fuck are you doing?" probably would have sufficed.
