Let me get this straight; this woman accuses a man of rape and he serves four years. It is later discovered she lied and she gets punished to one to three years. Where is the justice in this? Shouldn't the woman have served the same amount of time as the guy she claimed raped her?

Oh--- and get why she lied. She just accused the guy of raping her so her friends would not think she ditched them.

I agree she should at least serve the time he served, probably more. But there is SOME justice in this, there are plenty of people that lie to the cops and don't get punished.

Good point SQ, at least she got something for this. Too many times this happens and the bitch gets nothing ala Duke case even though she is gonna go down now for her recent arrests!

The guys in the Duke case never served time (although they did spend a boatload of money in legal defense costs). I am sure the guy would have a Cause of Action againt the woman; however I am sure she does not have a dime even if the guy would get a judgment against her.

I know they didn't do time but like you said first cost them alot of money and second their reputations were blasted!!

seems to me he should be able to sue the state. they did put him away for 4 years for a crime that never happened and my guess would be it was solely because of hearsay.

Testimony from the alleged victim about who raped her would be Direct Evidence. Hearsay would be evidence from a third party saying the guy admitted to them he raped her. In a Civil Case (suing the state for money) both forms of evidence potentially would be admitted fro the juries consideration. The judge would instruct the jury to rule on the greater weight of the evidence.

The State's defense in this case would be simple; they relied on the alleged victim to be truthful. A reasonable person would expect a victim not to lie.

Well...im assuming it was a jury trial...

Unless the state lied, fabricated evidence and such I dont know how ya could see the state.

Interesting thought. I believe Ive read where poeple wrongly incarcerated have won settlements aginst the govt

Very interesting case to follow if he indeed goes for it

I think they should go for it. Rape can be a very, very touchy subject........tooo much he said, she said type of things and when the R word is thrown around....the guy is automatically branded.

Unfortunately, rape is one of those crimes you are guilty until proven innocent, no matter what anyone else says thats a fact...as this can can attest to.

I hate hearing stories about this. It just causes more problems for real victims of rape seeking justice. Cases like this also shed light on the fact that our legal system isn't perfect.

I heard about this story a while ago... Absolute breakdown in the justice system. There should really be a criminal offense dedicated for this kind of thing and it should carry a BIG penalty like say minimum 15-20 years in prison or sentenced to repay the same time spent by the innocent + 5 years.

I think she should have to serve however many days he served exactly, then her 1-3 year sentence starts after that.
