Response:

I'm taking this issue just as serious as you are. You are threatening me with legal action that could end up ruining my life financially.

Your lawyer gave me until Monday morning so I will discontinue the use of freehuddle.com as an Ohio-based forum and/or redirect to OhioChatter.com on Monday morning. Since I will still retain ownership of the domain I retain the right to use it in the future for other ventures.

You say that your counsel “on these matters and it is in his opinion that I call your bluff”. I hope he a better counselor than a poker player! If he has access to Martindale Hubbell, he can ascertain how serious we take our legal standing. You already know that Matt Jenkins is our intellectual properties attorney. When we defended the Bucknuts mark (successfully) against intrusions from Ohio State, we used David Greer of Bieser Greer and Landis. When we instigated a class action suit (and prevailed) against Scout and Fox, we used the services of Charles Faruki and Jeff Ireland of Faruki Ireland and Cox. I realize you will think my “tone” is contentious once again but I am making my point: we are a business and we take this seriously.

ROFL!!! WTF?!?! Is he trying to scare you by name dropping mid level law firms?!

Justin, when you respond to their Attorneys tomorrow telling them that you have dropped Freehuddle, I will help pay, but PLEASE get Vorys, Sater, Seymour and Pease LLP to write a letter. It should only be a few hundred bucks. If he wants to act like an asshole bigdog and name drop, then he can deal with the big dogs themselves.

I love that they sued Ohio State, THEIR ONLY REASON FOR EXISTENCE, over intrusions.

I actually talked to someone from Vorys, he is the one who said their case is shit and that I should call their bluff.

So, his comment is basically like him kicking a 1,000 lb Gorilla while it is sleeping. What a smug dumb ass. Vorys is one of the top firms in the country in this field and if they said he doesn't have a case, he doesn't have a case.
Vorys, Sater, Seymour and Pease LLP provides business and legal counsel to clients throughout the United States and around the world. Since its founding in 1909, our firm has grown into one of the largest law firms in the country, with approximately 385 attorneys who are located in seven offices in Ohio, Virginia, Texas, and Washington, D.C.
DURR Hope they have a better poker face!

Justin:

Just between you and me…

We are not hard-asses. I got into this business (which is now Bucknuts and JJ Huddle and Nittany Network and Spartan tailgate and ScoutingOhio.com) because I enjoy what I do and the people I get to meet. I hope – eventually – that “the people” includes you!

I have to be aggressive and exhaustive in defending our marks. If you follow up with what you are saying in your last e-mail (discontinue using the “huddle” mark and any “huddle” reference in you re-direction), then we are good. Give it a week or two and then lets talk again on a less hostile basis…

UGH... his comments about lawyers is still pissing me off. He acts like you maybe talked to someone who has passed the bar
If he has access to Martindale Hubbell, he can ascertain how serious we take our legal standing.

It's just like dude, the largest firm you used has 40 lawyers. Justin, on the other hand, talked to a lawyer at a firm with over 350 lawyers that represents major major companies AND the federal gov't on this exact matter. For him to think that Justin hasn't talked to someone reliable just pisses me off to no end. Sure, just because you say you take things seriously doesn't mean others don't. Justin, next time you email him, you need to name drop your lawyer.

This guy is so stupid. "We're not Nethers".. REALLY? Huge difference, with Nethers being your last name and Huddle being a common word.

So Justin is he saying that as long as you removed "huddle" from redirecting to this site you are cool? What does he want to speak about on less hostile terms? Merging, LOL!!

My final email:

Lee,

Redirection to my new site has been removed from freehuddle.com. Now it just redirects the user to google.com. Can I file this under "resolved" now?

Thanks,
Justin

His response:

File it under “Resolved”, Justin.

E-mail me next week (if you still want to) and we can start over…

Heh. Not a fun exchange all around, but hopefully everyone can put this behind them.

FWIW, if someone does have a mark, they are required to litigate every single instance of someone infringing or they lose their rights. The law requires people to be overly vigorous to keep their intellectual property, which is bad for most people and good for lawyers, I guess. Still, I think OhioChatter is a good domain and a solid idea.

This is what they kept saying. I'm anxious to see when ohhuddle.com changes names.
