He isn't out because it was caught, he is out because he swung and the ball didn't hit the ground on the foul tip. Just like why is a dropped 3rd strike not an out until it is thrown to a base, or tagged the runner? Because an out has to end with someone catching the ball/having it in his glove tagging someone out. On a steal if it is foul tipped into the glove play goes on and the steal is good.

I think I read that once that someone supposedly had proof that someone else started the game earlier.
