A person being chased by a another with a knife hasn't had life threatening injuries. Doesn't mean their life isn't in danger. They should do what it takes to save their own life
That's going to be the question for the jury. The defense attorney tried to sneak in the question, "Could the next blow have been life threatening?" but there was an objection. But that's a slippery slope in my mind. With the testimony of the medical examiner, it casts doubt that TM was "smashing" GZ's head into the concrete. She said that the injuries were very minor and likened them to scratches...just that it looked worse because of the dried blood. If someone is "smashing" your head into concrete, you'd likely get more than just a few scrapes on the back of your dome.
But to say the next injury
could have been life threatening had he not stopped him does not float with me. TM
could have stood up and walked away if he wasn't shot. One of the witnesses
could have jumped in if the fight went on another minute. We can play that game all day. So I don't think that's a very strong defense as to why you kill someone.
