Someone jumping over the counter IMO is a reason to defend myself at all cost ... I too would have kept defending myself until to police arrived. Never know what the other person has and as long as I could keep them in a defensive postion the better for me.

I don't know what he was beating them with but I want one :D

He probably went to far when he kept swinging and swinging. But if someone is willing to jump the counter, then the person on the other side should be allowed to defend themselves

That's actually my thinking, as well. My issue, however, would be his apparent failure to order them not to move. If they attempt to get up or reach into a pocket/purse after you've warned them, then "swing away, Merrill".

That would be my defense - they were reaching for something. You can't dispute that with the video, so unless the other witness behind the counter contradicts the claim, you'd have reasonable doubt and have to acquit based on self-defense.
