NJ law states that it doesn't matter if a student is 18 or older. It is considered illegal until the student graduates regardless if the student is an adult. In other words, the student being 18 doesn't make it legal.
Many of the students in 12th grade are 18, a teacher can be charged for unbecoming behavior because they are considered to be in 'loco parentis' a term that refers to the legal responsibility of a person (teacher) or organization (the school) to take on some of the functions and responsibilities of a parent.

In Ohio it is a 3rd degree felony with a Max of 5 years in Prison.
I think a lot of people would think differently if the 18 yr old was their daughter and the teacher was her 25 yr old Male gym teacher.

Same applies to a psychologist and patient, etc. Completely illegal.

Plus, in Ohio (as has been said on here), the age of consent is 16, so if age was the only factor, you'd have sophomores in HS hooking up with teachers.
