I doubt this holds up very well in court, though OSU will probably just cut her a check to keep away the publicity...

If what she said was true, OSU(specifically the Blackwell) is certainly at fault. The guy called and asked if Andrews was staying there, then specifically asked for a room with an adjoining door to hers? And they gave him this, without notifying Andrews?
That's just plain stupidity. OSU deserves to get the shit kicked out of them in court if that's true.

Unless OSU owns the hotel (I know nothing about the place, never really followed the story) or one of their employees did the peeping, this makes no sense.

I'm almost certain OSU owns part of, if not all, of the Blackwell.

The lawsuit is in fact against Ohio State, being they own the hotel. I don't see what's wrong with the wording.

I didn't mean it like that. I know that is how it is being worded and technically its correct, but its just annoying that on ESPN it will probably show up with the exact title of this thread, which isn't exactly what is going on.

If what she says is correct, that the video taper asked specifically for a room next to hers, then her lawsuit has merit.

Totally playing devils advocate...but couldn't OSU's lawyers argue that the treatment of EA's situation would be no different if say, someone asked which floor the Buckeye's stayed on? We all know that they stay there before the games, some random fan could call and ask "what floor is the team staying on?" and request a room on/near that floor. They could probably argue that they did not know this guy was a creep

Do you think they would give some random fan a room on the team's floor or tell them which rooms they were staying in?? I would think the team goes there to limit distractions the night before a game and would have to assume the Blackwell has limits to who can access the team.

As karen said, you think if some random guy called up and asked for an adjoining room to Tressel's they'd give it to him at all, much less give it to him and not even notify Tressel? To make matters worse, EA is a young attractive, female celebrity. It's pure stupidity to grant some middle aged dude his request to stay in an adjoining room without notifying her.

I guess I say that because in order for OSU to be found negligent, they would have had to have known that the employee would give EAs room info away like that...meaning that either 1) It's not that far from common or 2) a "higher up" would have had to give it away. I'd be willing to bet that it was a rogue employee, and The Blackwell (like any other hotel) has some kind of Code of Conduct or Privacy Policy in place to prevent such matters (celebrity or not).

My wife had a stalker a few years ago (a guy had who worked in her office) - it's a very scary experience. If the allegations are true, Erin Andrews is entirely entitled to damages.
I have to think that a couple of the employees might have collected a little extra income very shortly after disclosing the information to this guy.
I have to question why TOSU thought that owning and operating a hotel was a good idea in the first place. FanFromTexas - you'd be the expert on this, but I understand it's one of the more lawsuit-prone business out there?

Incorrect.
OSU would be responsible under the doctrine of respondeat superior. The principal (OSU) is responsible for the acts/omissions of its agent (the hotel and its staff). The only defense would be the staff member acted outside the scope of his duties at the hotel. For instance, if the employee is a janitor, and he somehow broke into the computer and leaked the information, you might have an argument. However, this opens up other potential issues such as safety and security policies and protocols in place at the time and how this guy got access to them. A good lawyer will throw these arguments as an affirmative defense to the complaint, but it will be a steep hurdle to over come.

A lot of universities have these hotels on campuses. They are tremendous cash cows when you consider alumni events, parents, guests, etc. who stay there and other events held in the banquet centers. The university has trusts and excess insurance policies to cover potential claims. They obviously have looked at the risk benefit analysis of owning hotels and believe it works to their favor.

^^^ I haven't reviewed the Complaint but I guarantee OSU is listed as a defendant (along with numerous other parties). Therefore, she is suing OSU.

OSU would be liable for employees breaching protocol, but I'm not sure how EA's lawyers will prove that, especially since I'd guess, even if true, said employee isn't going to admit to it. OSU's lawyers will argue he stalked her and got the info just by following her. An internet search would probably tell you what games she is covering, and it might not be that hard in a college town to narrow it down to a handful of hotels she'd be staying at. Wait in the lobby until you see her.
Not to rule out a $100 or whatever slipped to a desk clerk, but I think he could have just as easily gotten this info on his own. You follow her around for a season or two and eventually you might see her at a hotel.

The guy testified in court that they gave away her room number and gave him a room right next to hers when asked. If he waited until she showed up at the hotel, it's highly doubtful he could have gotten a room at all, much less one next to her's.
