I could see some people not liking it in their opinion, but how could you call it overrated? It was directed extremely well and the acting was top notch.

Nolan has gone for much more dark and demented villians....Depp would fill that role perfectly

Malcovich would be a GREAT villain in this series. Dark personalities that get the audience to cheer for the bad guy.
He has it, Depp has it, Ledger had it, Kevin Spacey has it, and a select few others.
I dont think some of the others mentioned have it, and thus would make a bad villain. Seymour-Hoffman has it, but if the Penguin isnt going to be cast I dont see much of a role for him.
