My mother in law just went to see a divorce lawyer . They are not currently living together and should be divorced. The part that gets tricky is that she wants to take half of his money he gets a month. He is a retired steel worker whose company went under and he receives a small pension from that. He also had a stroke a few years ago and is on disability, as he can no longer work. He gets enough money to pay his bills and that's about it.
The lawyer told my mother in law it's a clear case and she will get half. That the judge just cares about how long they were married . Is this true? What if any rights does my father in law have? This guy bends over backwards to help her and my sister in law any chance he gets and gives them some money when he can now. me and my wife are trying to talk her out of the monetary part

If your mother-in-law is your wife's biological mother, for your own sake, I would suggest you keep a close eye on how your wife handles this situation… apple doesn't fall far from the tree per se. …just sayin.

It also seems strange that his disability income would be considered half hers. After the divorce is he miraculously only going to be half disabled? She is the one choosing to file for divorce so she should have to forfeit any right to any disability income he receives… especially since the disability he suffers from was not caused by a work-related injury. I'm not a lawyer so my thoughts could be all wrong!

I think Apple is correct on every point...

Is anything on a file server if so your father in law will be dead before anything get to the courts.... :)

That could be the case, depending on the state. There are laws and formulas that determine this sort of thing. I am not an expert, but you could consult your own attorney as to what your options are, and/or make sure that you father in law is properly represented.

Luckily my wife is nothing like her. She told her mother she was dumb and should not do that.

we will definitely be telling him to get an attorney and fight this . Thanks for the advice
