Aside from an extreme view on preventing theft of property (which by the letter would seem to be the right decision)...It's interesting that this was viewed as theft of property rather than failure to perform services rendered, i.e. a "contractual" dispute rather than theft.
On second thought, it might have actually been the illegal activity that aided the defense of theft vs. a contract/service issue - can't enter into a contract for an illegal service.
On the other hand, you might argue that since you can't contract for sex the $150 is actually a gift....and therefore no longer his property to protect with lethal force.
