Aside from an extreme view on preventing theft of property (which by the letter would seem to be the right decision)...It's interesting that this was viewed as theft of property rather than failure to perform services rendered, i.e. a "contractual" dispute rather than theft.

On second thought, it might have actually been the illegal activity that aided the defense of theft vs. a contract/service issue - can't enter into a contract for an illegal service.

On the other hand, you might argue that since you can't contract for sex the $150 is actually a gift....and therefore no longer his property to protect with lethal force.

It doesn't seem like that kind of line of reasoning was discussed.

From an article linked in the article the OP linked:
The Texas law that allows people to use deadly force to recover property during a nighttime theft was put in place for “law-abiding” citizens, prosecutors Matt Lovell and Jessica Schulze countered. It's not intended for someone trying to force another person into an illegal act such as prostitution, they argued.

Since we're laughing at TX...

A bit actress, who's husband apparently filed for divorce, appears to have attempted to frame him in the ricin case. Honestly, it's cases like these two that make you say "some people just don't deserve the liberty they are supposed to have".
