Strange Ex-Employer Tax Situation Advice

So, my Mother works for a lady who owns a small business and my wife is a former employee at the same location. Their employer has refused to give them their W2's (keeps lying/making excuses why). Also, she does not give employees pay stubs with their checks. All the employees and recent former employees are in an outrage but the lady is just a straight up biotch and a bit of a psycho and treats them like shit. Her business is going under and the IRS has taken pretty much everything she has at this point and it won't be long until she has to shut down so she just doesn't give a flying fuck and is ignoring the fact that she is puting her employees in a tough spot.

Called the IRS and reported this etc but basically, it's on the employees to figure out what they made. The only thing is I don't want to have to end up paying too much unnecessarily if my wife calculates wrong. Nor do I want to overpay and then not get the money back, which will happen because my wife still owes some school loans and I believe that's where the money will go if she over-calculates her earnings.

Anyone have any advice to force this c*n T to cough up the forms ??? Anyone ever have a situation like this?

I'm assuming you got Form 4852 or whatever it is from the IRS. Beyond doing your best from bank statements and available pay-stubs there isn't much else you can do. I'm guessing she hasn't given out W-2's not because she's just being an ass, but because she just hasn't kept track of the appropriate details to be able to even distribute that information to the employees. At least that's what your description makes it sound like.

But I'm no tax expert, you might want to consult a lawyer (maybe specifically a tax attorney) for an initial interview to see if there is anything that can be done.

First contact the National Labor Board they will do more to try to get a w2 from your employer then the IRS. Otherwise you your bank statements and hire a tax attorney to help you. It sucks to have to pay for help but it's the best thing to do at this point.

It's better to file on time then file late unfortunately your probably gonna get screwed.

Pro tip: Don't work for someone under the table. It may sound nice until the IRS pounds you up the ass.

Not sure how that applies to this topic. "Under the table" implies cash payments with no intention of claiming the income. Since the employees here are actually asking for W2's, this wasn't an "under the table" operation, but rather just a shitty employer who doesn't keep good enough records.

If they are just getting raw checks, that's called being paid under the table.

There are a lot of small businesses that don't give pay stubs. My wife gets a check from the shop owner she works for each week with a post-it note that tells her the breakdown of taxes. It's pretty easy to lose that. So if it ever got to a point where the owner refused to give a W2, I could be in the exact same situation as the OP.

I didn't see any debate going on here. I saw the OP asking for advice on what he should do, and then people giving him advice.
