I know someone who fits this profile.
Works seasonal job.
During the off season (November - March) he collects unemployment benefits.
JUST got hired in a NEW job....worked one day and decided that he didn't like it and QUIT the NEW job.
Question: Can he now go back and start collecting unemployment benefits again from the "seasonal job" he was originally laid off from until THAT seasonal job starts back up again in March or did he just screw himself out of that.
I know......the guys a loser / MORON - don't need to go there!!!!!!!!!!!!!!!

I'd say by quitting he didn't establish just cause for leaving the job, but IANAL.

Once he took the new job and that employer file him as employed and then quit he cut off his unemployment

who knows...by only working one day they may not have filed all the proper paperwork with the state or whomever and he may get away with it

I'm not an expert on unemployment benefits but we have some liberals on the forum so I have no doubts your question will be resolved shortly.

Most likely it will not be caught by overworked and lazy gubmit employee. I'm guessing they focus mostly on new applications, and since he's already receiving it probably no one will pay attention. If it does get caught I bet it will be how you described it. If he has worked for the seasonal employer for a couple years or more, then they probably expect him to be on unemployment right now and just assume nothing has changed

My wife has worked for ODJFS in child support and unemployment for 11 years. They may not catch it right away, but they'll catch it and he will have to pay back what he received that he shouldn't have.

You actually can work some while on unemployment. You just have to claim it in your weekly report. If necessary, they deduct the amount from your benefits. Now, could be that since he became on actual employee, his benefits were technically terminated. But if he hadn't reported yet that he had a job, he may get away with it. They may catch him later, but I doubt it.

I'd be interested in what he said when he filled out his weekly unemployment claim. If you start work you're supposed to report it on the form that you've started work and how much you've earned. If he didn't report his earnings and they see he got paid for even a day's work, he's gonna get in some trouble for lying on that form.
If however he reported that he started a new job, and reported his earnings, then the following week they're going to ask him if he quit, was laid off, or was discharged from work. If he says yes, they'll ask why and he'll have to either say he quit or was fired. If he says he was fired then they'll call the employer to find out the story and he'll still be fucked.
