She got into a fender bender one rainy morning about two years ago. Zero damage to the car. No physical injury.
Today, we got a notice that she is being sued for $25,000 because this woman is claiming that she can no longer work because of it.
The kicker? They live less than a block away.
This lawsuit is complete nonsense! What on earth are we supposed to do? What kind of legal cost should we expect to incur?
I'm beyond irate at this. I'd love to go over and read them the riot act, but of course, I'm not going to. Still, I have absolutely no idea what to do.
Any ideas? Legal experts? Anyone?

But seriously, sounds like it sucks. Go talk to a lawyer and make sure you are open and honest. If it's truly a crazy claim it should be resolved in your favor. I don't know on costs, but paying a lawyer to represent you well will almost certainly be cheaper than paying for her medical costs.
Also, upperdeck her.

1. Hire the best lawyer you can find that handles this type of case.
2. Do what your lawyer says to the best of your ability.
3. Do absolutely nothing else related to the case.

Don't think this didn't cross my mind, but we don't interact much. Can't see any even suspicious grounds.Belly35;1315416 wrote:Counter sue for five times as much
GoRocks, wife and I are strapped, and I'm not sure we can afford either.

I wouldn't know who is the best for these types of cases, and I probably couldn't afford them anyway.queencitybuckeye;1315418 wrote:1. Hire the best lawyer you can find that handles this type of case.

Others could be of more help with the formers. As to the latter, not to be snarky, but not being represented is just not an option. If you think you can't afford an attorney, can you afford a $25K judgement, because that's the alternative.O-Trap;1315421 wrote:I wouldn't know who is the best for these types of cases, and I probably couldn't afford them anyway.

Thanks. We'll definitely look into this. It's been long enough that I flat-out don't remember, but I know the police did show up, so I'm assuming insurance was involved. I wasn't there, so I'll have to ask.
All television shows indicate about $10K.said_aouita;1315423 wrote:I'm sure you could find somebody to kill her for less than 25k.

It was a friend's car. Wife was driving, but went through friend's insurance, apparently, since it was friend's car. Does that change things?

I can talk to my professor who used to be a lawyer in the area if you want me to. Im sure he could can offer some basic advice and/or refer somebody who specializes in these cases.
Complete bullshit. I'm pretty sure 2 years is the limit for filing a lawsuit in these situations. The same thing actually happened with my mom when I was younger, though I'm not sure what ever ended up happening.

That is correct, the statute of limitation is 2 years in Ohio for bodily injury civil cases (generally speaking):Pick6;1315451 wrote:I'm pretty sure 2 years is the limit for filing a lawsuit in these situations.
http://codes.ohio.gov/orc/2305.102305.10 Bodily injury or injury to personal property.
(A) Except as provided in division (C) or (E) of this section, an action based on a product liability claim and an action for bodily injury or injuring personal property shall be brought within two years after the cause of action accrues.
My guess, however, is that "about two years ago" is actually less than two years ago, otherwise any competent lawyer wouldn't have brought the case this far.
