On a raft. :)
“Modene had been floating on the river for the day and consuming alcoholic beverages the entire time,” troopers wrote in their “daily dispatches” log on their website.

At 0.313, Modene’s breath-alcohol content was almost four times the legal limit for operating a vehicle, 0.08.
Under Alaska’s DUI law, operating a water craft means to “navigate a vessel used or capable of being used as a means of transportation on water for recreational or commercial purposes on all waters, fresh or salt, inland or coastal, inside the territorial limits or under the jurisdiction of the state.”
I cry Buuuuullllllllshiiit! What's he gonna do, bump into a salmon?

Cabrewing is definitely illegal. You can certainly get an OVI that way.

I know of a few friends who in fact got an OVI for cabrewing. Always brings the lulz.

yeah..ya can get busted for drinking and driving a boat...just like ya can for drinking and riding a bicycle, lawnmower, motorized bar stool, etc.

Saw someone last summer get put through the same test as drivers of car get and then taken away. It was a bit more interesting than the fireworks that night. Dude had to be embarrased as it was done in front of 100 or so people.

I saw the same thing happen to a guy in a canoe on the Mohican river near Loudonville.

Funny thing is just about everyone on the river was hammered and he was in the wrong place at the wrong time. It really killed the party atmosphere and turned the rest of the trip into a a voyage of paranoia.

So does that mean if he was just floating with a life jacket, he would have been legal? Or what about just wading?

I don't think either of those are considered a "vessel."
