I have always wondered if someone would try to reject an entire jury if they were not peers, i.e. not same intelligence level.

my point is that how in the fuck is a doctor at fault for some guy having a heart-attack while him and his buddy double-team some hooker at the airport hilton? I just don't get it. From the docs attorney:

"Dr. Gangasani did everything he could to prevent Mr. Martinez's death. Mr. Martinez had a well-documented history of not following his doctors' instructions. Here, after examining Mr. Martinez, Dr. Gangasani recommended follow-up cardiac testing, and he offered Mr. Martinez an appointment for the next day to have the testing performed. Mr. Martinez refused, and instead he scheduled the testing to take place one week later-the day after the sexual encounter that he had planned. Dr. Gangasani also specifically told Mr. Martinez not to engage in any strenuous activity, but unfortunately Mr. Martinez ignored this warning. Dr. Gangasani also gave Mr. Martinez appropriate medications, including aspirin, nitroglycerin, and cholesterol-lowering medications, and told Mr. Martinez to go to the emergency room immediately if he experienced any further chest pain. Thus, while Mr. Martinez's death was a tragedy, it could have been prevented if he had simply followed Dr. Gangasani's recommendations and instructions."

How is that the action of someone who is 60% (lulz) responsible for someone dying? Jesus.

Well, first impression is "why DIDN'T the doctor advise against strenuous activity?". Then you recall Darwin and figure this guy is pretty dumb for not knowing "hey, I've got some issues with my heart I better take it easy".

The standard I would have applied is a guy having risky 3-way sex, and excluding his wife, is likely not going to heed a doctor warning.

that doesnt mean he was always like that, it could have been something that developed over time.

What's really messed-up about this is if she had divorced him, she would have gotten half his wages/savings/pension. If he died normally, insurance might have paid several hundred thousand (and then she receives his pension, which she still gets whatever it is for 10 years).

As far as punitive damages, isn't future earnings potential already punitive enough? Would that be even $2M? So 60% would have been $1.2M, not $3M.

Assuming she didn't know or approve of his sexual exploits, she's basically won the lottery. I'm sure the "justice" in this case will be served when she blows thru that cash like so many lottery winners. At least the guy didn't die on the job or the city/state might have been on the hook, too.
