a little bit of bad luck, a little lack of work done by the police on scene, a little bit of normal unreliable eye witness accounts and a little of bit of a jail sob story. in the end, they were in jail for less than a day, but you would think it was for weeks.

Poor police work quite possibly rising to the level of negligence. There will almost certainly be a settlement check written.

Assuming the story as written is pretty much the whole story and accurate, probably so.

hind sight is 20/20. people can be held for investigation. they were held for less than 24 hours. this isnt CSI, store cameras and witness reports dont happen as fast as David Caruso can spit out a one liner. had this couple been any normal joe and jane, this story would have never made headlines.

That shit happens to me you'd better fucking believe it makes headlines and that department hears from my attorney. And it's not like I'm some litigious bastard either.

on what basis? so if everytime the police went to arrest somebody and the suspect said "it wasnt me", they should just say "well sorry for bothering you sir, have a good day."

plus, remember the wife was arrested for obstructing, not for the original crime. whether or not it was her husband who hit the guy, she still committed a crime.

No, but they should look into it if they articulate a reasonable argument and maybe take them into custody but immediately investigate it.

sounds like a shitty police show where the officer went with his gut instead of actually looking at evidence. derp derp.

after reading that story for a second time, there is no way that some of these police officers arent fired. its absolutely ridiculous that shit like that can happen when evidence to the contrary is being literally shoved in their face.

Had this been any normal Joe & Jane, they would have spent a minimum of 72 hours in jail, more if it happened over the weekend or holiday. Depending on their financial situation, they would probably spend more time in jail until their family raises the money for bond and an attorney! Had this been any normal Joe & Jane, it would have been far worse, all because basic investigation wasn't done.
