Except the evidence seems to suggest he didn't actually resist arrest.

Dude was probably just upset about getting a jaywalking ticket because that's lame and was spouting off about it. Not smart to do but yelling at an officer isn't illegal.

Of course there isn't a video showing just before the arrest so who knows other than the people that were there.

True, because they're the only witnesses who have nothing to gain from this. Gaspard will say he wasn't resisting because it benefits him and the cops will obviously say he was because it benefits them.

If a 6'8 300 pound man was angry and yelling at the cops and they tell him to calm down and he doesn't, it will escalate. My guess that is what happened, which is why the people around feel he did nothing wrong.

I jaywalked there as well. In fact I jaywalked with a cop one time this weekend near the convention center.
