They changed the rules to make it preventable, but I don't think there is an ironclad rule there to 100% avoid it. If they piss away all of the players (especially pitchers) and end up going 20 innings the situation would be the same.
I GUARANTEE you Selig would NEVER call it though. He will have those last two pitchers throw until their arms fall off before calling a tie.

You can't, that's the point. If you set the under to 4 home runs, and they hit 4 home runs, the bet is worthless.
