The plaintiffs “lobbed their opening volley” Friday in the US Court of Appeals for the District of Columbia Circuit by filing an initial, 192-page brief that lays out “the merits of their case,” The Hill says. The Clean Power Plan “is already on hold, thanks to a surprise Supreme Court order earlier this month,” the article notes, adding that the plan’s opponents “must still make their case” to the Washington, DC appeals court. The brief from the coalition of states and businesses is predicated on the view that the Environmental Protection Agency “has stepped outside the bounds of its authority under the Clean Air Act to limit pollution.”
